Terms of sale

These terms apply to every order placed with Custom Glass Direct.

Draft terms — for Jason to review before launch. Not legal advice; have them checked by a lawyer before relying on them. Last updated: PLACEHOLDER date.

1. Who we are

Custom Glass Direct is a trading name of PLACEHOLDER — legal entity name, ABN XX XXX XXX XXX (PLACEHOLDER), Melbourne, Victoria (“we”, “us”). We sell cut-to-size glass and glass hardware online. Your glass is manufactured for us by our glass processing partners and delivered by us or our couriers.

2. Supply only — no measuring, no installation

We supply goods only. Measuring and installation are not included in any order and we don’t provide site measures, installation, or advice that your design complies with building codes. You are responsible for measuring, for choosing glass suitable for its location (including compliance with AS 1288 and any building requirements), and for safe handling and installation.

3. Your measurements and specifications

Glass is made exactly to the sizes, quantities and options in your confirmed order, within normal manufacturing tolerances. You are responsible for their accuracy. By ticking “I confirm my measurements are correct” you confirm you’ve checked them. Toughened glass can’t be altered after manufacture. See our measuring guide.

4. Prices and quotes

  • Prices are in Australian dollars and include GST.
  • The price shown online is a quote based on the details you enter. Paying for your order at checkout is an offer to buy; a contract is formed when we accept your order. If there’s a problem with your sizes or options we’ll contact you before we cut.
  • If we find a pricing error, a specification that can’t be made, or a delivery address outside our zones, we’ll contact you before taking payment. You can then accept the corrected order or cancel at no cost.

5. Payment

Full payment is taken at checkout, before your order goes into production. Card payments are processed by our payment provider; we don’t see or store your full card details.

6. Changes and cancellations

You can change or cancel your order free of charge until it has been sent to production. Because each piece is custom made, orders can’t be changed or cancelled once production has started, except as required by law.

7. Lead times, delivery and pickup

  • Lead times are estimates and start after payment and confirmation. We’re not liable for reasonable delays outside our control, but we’ll keep you informed.
  • Delivery is to the Melbourne metro zones on our delivery page, to an accessible ground-level location. Someone 18+ must be present. Failed or re-arranged deliveries may incur a fee.
  • Risk in the goods passes to you on delivery or pickup. Ownership passes to you when we’ve received full payment.

8. Inspection, defects and remakes

Inspect your goods on delivery or pickup and tell us about any breakage, damage or defect within 48 hours, with photos. Our remakes & returns policy forms part of these terms.

9. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these terms excludes, restricts or modifies those rights.

10. Liability

To the extent permitted by law, and subject to section 9, we are not liable for installation or labour costs, or for loss caused by incorrect measurements or specifications supplied by you, unsuitable use of the goods, or handling, transport or installation after delivery.

11. Privacy

We handle your personal information under our privacy policy.

12. General

These terms are governed by the laws of Victoria, Australia. We may update these terms; the version on our website when you place your order applies to that order.
